SAN FRANCISCO (AP) - Google is dangling a low-priced laptop computer in front of consumers as rivals Microsoft and Apple prepare to release their latest gadgets.

The lightweight computer unveiled Thursday will sell for $249 and is being made in a partnership with Samsung Electronics Co. Ltd., which also makes smartphones and tablet computers that run on Google's Android software.

The laptop will run on an operating system revolving around Google's Chrome Web browser.

Like other so-called Chromebooks, this laptop doesn't have a hard drive. It functions like a terminal dependent on an Internet connection to get to information and applications stored in large data centers run by Google Inc. or other technology providers.

It's the least expensive Chromebook that Google has released in the two years that it has been working on the product line. Google and Samsung released a slightly more sophisticated Chromebook priced at $449 in the late spring.

The lower-priced model will go on sale early next week in more than 500 Best Buy stores in the U.S., as well as on various websites. Google hopes to begin accepting online orders at its Play store by this weekend.

With an 11.6-inch screen, the new Chromebooks also will have a larger display than tablets selling in the same price range.

The laptops will be set up to automatically use all of Google's services, including its search engine, Gmail and YouTube video site. Because the laptop lacks a hard drive, Google also is offering 100 gigabytes of free storage on computers kept in its eight data centers. Those remote computers provide the backbone for Google's online storage service, Drive.

Despite the low price, the new Chromebook will face a tough time winning over consumers because it isn't set up like a traditional PC with a hard drive, said Gartner Inc. analyst Carolina Milanesi.

"A lot of people are going to see it and think, 'Once I have it, what exactly do I do with it?'" Milanesi predicted.

Google, which is based in Mountain View, Calif., will try to educate and woo prospective buyers by setting up Chromebook kiosks in Best Buy stores where staff will be on hand to field questions. The company also will promote the new Chromebook in television ads.

The attempt to grab a few early headlines Thursday backfired, though, when Google prematurely released its third-quarter earnings while the company was providing a preview of the low-priced Chromebook to a group of reporters. Once the earnings slipped out, some reporters bolted from the laptop presentation to focus on numbers that disappointed investors.

Where an insured deposit taking institution (and let?s just call it a bank to make things easy) is subject to a receivership order under the Canada Deposit Insurance Corporation Act (CDIC Act) the government can incorporate a bridge bank to take over the good assets and run the bank until it can be sold.?If it does so the usual exemptions from the statutory stays for termination, netting and collateral enforcement for eligible financial contracts (EFCs) are not available if CDIC either undertakes to guarantee the obligations of the insolvent bank or undertakes that the bridge bank will assume those obligations (and CDIC is bound to financially support the bridge bank).?Let?s call this the conditional bridge bank stay.

Conditional Bridge Bank Stay Prevails over PCSA Exemption

Those of you who could pass a test on the Canadian ISDA Netting opinion will know that under the current law it is unclear whether the EFC exemption under the Payment Clearing and Settlement Act (PCSA) overrides the conditional bridge bank stay where the parties to the EFC are both financial institutions.?The amendments proposed by Bill C-45 will clarify that the conditional bridge bank stay prevails over the PCSA EFC exemption.?

New temporary unconditional stay

There is also a significant change to the bridge bank stay.?When an order incorporating a bridge institution is made, there will be a short unconditional stay imposed on EFCs by a new section (s.39.15(7.01)).?This stay ? let?s call it the temporary bridge bank stay- ?is not conditional on CDIC making the undertakings described above. The period of the stay is from the time of the order incorporating the bridge institution until 5 pm on the following business day.?So, if an order is made Friday morning it would last until 5 pm the following Monday.?As with the conditional bridge bank stay, the temporary stay prevents a party from relying on the following triggers of its right to terminate, net or realize on collateral - (a) the bank?s insolvency, (b) the making of the order appointing CDIC as receiver of the bank or incorporating the bridge bank, or (c) the EFC being assigned or assumed by the bridge bank.?It does not prevent relying on other default events, such as failures to deliver credit support or payment defaults. Essentially the provision gives CDIC some time to determine which EFCs it wants to assign or stay termination of.?(And as with the existing conditional bridge bank stay, no cherry-picking is permitted.)

Changes to the Conditional Bridge Bank Stay

The current conditional bridge bank stay does not allow a counterparty to rely on the making of the receivership order or the assignment of the EFCs to a bridge bank as triggers for termination, netting and collateral enforcement.?This will be amended to include the same triggers that apply to the temporary stay.?Again, performance defaults such as failure to provide margin can still be relied on.?

The amendments will add provisions similar to those in other insolvency statutes to the effect that provisions of an agreement are of no force and effect if they permit actions contrary to the temporary bridge bank stay or conditional bridge bank stay or if they provide that the insolvent bank or bridge bank ceases to have the rights to deal with assets that it would otherwise have upon the triggering events. ?

Clearing House Exception from the Temporary Stay

Importantly certain clearing houses will not be subject to the temporary bridge bank stay. New subjection 39.15(7.02) will provide that it does not apply to an EFC between the bank and a clearing house (as defined in s.2 of the PCSA) that provides clearing and settlement services for a PCSA section 4 designated clearing and settlement system (which are those systems deemed systemically important) or that is a securities and derivatives? clearing house as defined in section 13.1(3) of the PCSA (CDCC, CDS, ICE Clear Canada and those designated as such by the Minister of Finance). As under the current law, clearing houses (designated or not) are not exempt from the conditional bridge bank stay.?So, unless the clearing house manages to port or close out transactions during the temporary stay period, a stay will kick in.?It is not clear how these provisions will work in practice for clearing relationships. There are clearly issues that will have to be worked out in advance between CDIC, the members and the clearers (e.g. how the bridge bank could become a member assuming the EFCs are assigned to the bridge bank, and if they are not how the insolvent bank can continue as member when it may no longer meet membership criteria, what the margin requirements for the member will be, etc.).???

Stays Continue if Insolvent Bank Wound-up

Under the current Act any of the section 39.15 stays end when the restructuring is complete or a liquidator is appointed for the bank under the Winding-up and Restructuring Act (s.39.18).?New section 39.18(2) will provide that certain provisions continue to be effective in these circumstances, including the temporary bridge bank stay (and the clearing house exemption to it), the effectiveness of the contractual provisions allowing termination, netting and collateral enforcement on the triggering events noted above and the power of CDIC to assign to a bridge institution.?

Republican Governor's clout needed on federal spending: Virginia Democrats

WASHINGTON (Reuters) - Virginia Democratic congressmen urged the state's Republican governor on Friday to use his influence in Washington to press for a "balanced" deficit reduction deal, one with more revenue to replace some of the looming spending cuts they said would devastate Virginia's economy.

The appeal to Republican Governor Bob McDonnell comes just days after he urged President Barack Obama to push Senate Democrats to pass a Republican plan to halt spending cuts that would hit military and defense contractors in January.

Virginia stands to lose 207,571 jobs as a result of the coming across-the-board cuts of $109 billion for federal programs, according to a study commissioned by the Aerospace Industries Association. Half the cuts are allocated to defense-related programs, and half would hit other discretionary domestic spending.

But in Virginia, which is home to the Pentagon and many military contractors, the job impact from defense cuts would be larger, with 136,191 jobs lost, compared to 71,380 jobs lost from non-defense cuts, according to the AIA study.

McDonnell argued that the defense cuts also would put national security at risk.

The Republican plan to halt the military cuts, written by Republican vice presidential candidate Paul Ryan and passed by the House in May, would shift the first year's worth of cuts to domestic programs, several of which aid the poor, including Medicaid and food stamps. The Democratic-controlled Senate has declined, so far, to debate or vote on the plan.

In their letter to McDonnell, Congressmen Jim Moran, Gerald Connolly and Bobby Scott said the Republican plan would simply push the burden of cuts onto domestic programs and trigger "massive layoffs" in Virginia's large non-defense federal workforce.

"Your concerns about the impact on Virginia of a sequester (automatic spending cuts) to defense spending, which we share, applies almost equally to non-defense discretionary spending, to which your letter (to Obama) is silent," the Democrats wrote to McDonnell.

The congressmen said McDonnell was "uniquely positioned" to influence House Speaker John Boehner and Majority Leader Eric Cantor - a Virginia Republican himself. McDonnell has campaigned tirelessly for Republican presidential nominee Mitt Romney in the battleground state.

"We hope you will join us in calling on Speaker Boehner and Majority Leader Cantor to begin discussions on a balanced deficit reduction package that can garner bipartisan support," they wrote.

A spokesman for McDonnell in Richmond was not immediately available for comment on the Democrats' request.

The aerospace industry and its main union also on Friday tried to push the defense cuts into the limelight in the final presidential debate on Monday, calling on the moderator, CBS newsman Bob Schieffer, to include a question on the topic.

The Aerospace Industries Association and the International Association of Machinists and Aerospace Workers in a joint statement noted that the subject had received "scant attention" in previous debates, despite its substantial impact on the economy.

"Sequestration would be a disaster for our national security," they said. Monday night's debate is set to focus on foreign policy.

Health economist hopes findings will lead to bereavement early intervention

The death of a child is a tragic event for a family, bringing with it feelings of numbness, anger, guilt and denial. And, unfortunately, for many families, the loss becomes too much to bear.

A new study co-conducted by a researcher at Rochester Institute of Technology uncovers the strong connection between the death of a child and the mortality of the mother, regardless of cause of death, gender of the child, marital status, family size, income or education level of the mother.

Javier Espinosa, assistant professor in RIT's College of Liberal Arts and an expert in health and labor economics, compiled results from nine years of research after studying more than 69,000 mothers, ages 20 to 50. According to Espinosa, the impact to mother mortality is strongest in the two years immediately following the child's death. In fact, Espinosa's research suggests that mother mortality increases 133 percent after the death of a child.

"To my knowledge, this is the first study to empirically analyze this issue with a large, nationally represented U.S. data set," Espinosa says. "The evidence of a heightened mortality rate for the mother, particularly in the first two years of the child's passing, is especially relevant to public health policy and the timing of interventions that aim to improve the adverse health outcomes mothers experience after the death of a child."

Espinosa's results, "Maternal bereavement: The heightened mortality of mothers after the death of a child," co-written by William Evans from the University of Notre Dame, were recently published in the journal Economics and Human Biology.

Espinosa has also conducted extensive research on spousal mortality in which his studies lead to the conclusion that men who are grieving from a wife's death experience a 30 percent increase in mortality. For women, there is no heightened mortality due to the death of a spouse, but there remains a correlation between the timing of the wife's and husband's deaths. Espinosa believes he understands why this happens, given the data are based on a sample of married people born between 1910 and 1930.

"When a wife dies, men are often unprepared. They have often lost their caregiversomeone who cares for them physically and emotionally, and the loss directly impacts the husband's health," he says. "This same mechanism is likely weaker for most women when a husband dies. Therefore, the connection in mortalities for wives may be a reflection of how similar mates' lives become over time."

Espinosa, who earned his doctorate in economics from University of Maryland at College Park, is an expert in health economicsthe sub-discipline of economics that deals with the efficient allocation of health-care resources. He teaches health-care economics and microeconomics at RIT.
