Defense: Key tactic in Jackson case dumped in May (AP)

LOS ANGELES ? A defense lawyer in the trial of Michael Jackson's doctor disclosed in court Friday that he knew months before trial that a theory that the singer drank a fatal dose of the anesthetic propofol would have to be abandoned.

Defense attorney J. Michael Flanagan, who represents Dr. Conrad Murray in the involuntary manslaughter case, made the statement without the jury present.

The idea of Jackson orally giving himself the fatal dose was long touted by defense attorneys as a centerpiece of their case. Documents had been filed and arguments heard about studies on the issue.

The attorneys have even referred to a fruit juice jar found on Jackson's bedside table, suggesting he had taken the drug with juice.

Flanagan initially dropped the bombshell Wednesday that the defense was abandoning the strategy.

"We are not going to assert at any point in this trial that Michael Jackson at any time orally ingested propofol," said Flanagan, who revealed he had commissioned a study that concluded propofol would not be absorbed into the body when ingested.

But he did not say when the study had been done.

Prosecutors and the judge appeared stunned at the announcement

At Friday's hearing, on a day when testimony was not heard, Deputy District Attorney David Walgren told the judge, "We are dealing with an ever-changing defense. It was just a couple of days ago they abandoned oral propofol."

"Oh, your honor, that is not correct," Flanagan said.

"No?' Walgren asked incredulously.

"We abandoned oral propofol months ago," said Flanagan, saying they were swayed by a report from the leading expert on the drug, who is expected to testify for the prosecution next week.

He said Dr. Steven Shafer had questioned "the bioavailability of oral propofol," meaning whether it would be absorbed into the body if swallowed.

Flanagan said the defense decided to have its own study conducted and, "We determined back in May that bioavailability of oral propofol was not feasible."

Superior Court Judge Michael Pastor said he had never been advised in advance that the theory would be dropped. He said he would not be dealing with Walgren's claims of an ever-changing defense.

"I don't have to go there," he said. "It is what it is right now."

Murray was not in court for the hearing. He has pleaded not guilty to involuntary manslaughter in the June 2009 death of the superstar from an overdose of propofol.

Flanagan's disclosure offered a backstage look at possible defense gamesmanship in leading prosecutors to prepare to answer a defense theory that would never be presented.

A defense attorney not involved in the case said it is not an ethical or legal obligation of the defense to keep the prosecution posted on its strategies.

"I don't personally see a violation," said attorney Thomas Mesereau Jr. "You're supposed to operate in good faith, but you don't have to tell them every little strategy you intend to employ ... . Maybe this defense team was debating whether to use the issue up to the end."

In opening statements, defense attorney Edward Chernoff told the jury he would allege that Jackson self-administered drugs but did not specifically mention oral ingestion of propofol.

In other developments, the prosecution said its last witness will be Shafer and his testimony could take a day. The defense said it would call 15 witnesses including police officers, experts and some character witnesses. Attorney Nareg Gourjian estimated that would consume the rest of next week.

Claims and trade data suggest modest improvement (Reuters)

WASHINGTON (Reuters) ? New claims for jobless benefits were little changed last week and the trade deficit narrowed marginally in August, indicating a modest improvement in the economy.

Initial claims for state unemployment benefits dipped 1,000 to a seasonally adjusted 404,000, the Labor Department said on Thursday. Economists had expected claims to rise to 405,000.

A separate report from the Commerce Department showed the trade deficit fell to $45.61 billion in August from $45.63 billion the prior month. Economists had expected the trade gap to widen to $45.8 billion.

"Three consecutive weeks of claims around 400,000 are somewhat reassuring, as they suggest that layoffs remain contained despite high uncertainty in the economy," said Guy Berger, senior economist with RBS in Stamford, Connecticut.

"We continue to expect moderate growth rather than a recession, but in the latter scenario claims would be among the earliest signals of a contraction in the labor market."

The dollar extended gains against the euro on Thursday after the data, while prices of Treasury securities rose modestly.

Stock index futures trimmed losses as investors focused on weaker-than-expected economic data in China.

The trade report also showed that the U.S. trade gap with China widened to a record high as imports hit an all-time high of $37.4 billion. The U.S. Congress has been considering legislation to penalize China for its trade and currency practices.

Nonfarm employment increased 103,000 in September after gaining 57,000 the prior month, the department reported last week. While payrolls last month were lifted by the return of 45,000 Verizon Communications workers, key measures of labor market health showed some improvement.

Initial claims stayed close to the 400,000 mark usually associated with some improvement in the jobs market for a third straight week.

More signs of improvement in the labor market could further diminish the chances of a new recession, but much of the economy's fortunes now depend on how Europe handles its debt crisis.

A Labor Department official said there was nothing unusual in the state-level data, but noted that claims tended to show large increases at the start of a quarter.

The model used by the department to smooth out seasonal variations had expected a large increase in claims last week and since the figure came in close to expectations, there was little change in the seasonally adjusted level.

Since Monday was a federal holiday, four states including California and Virginia, gave estimates. But the Labor Department official said these tended to be accurate and he did not anticipate major revisions to the data next week.

The four-week moving average of claims, considered a better measure of labor market trends, fell 7,000 to 408,000.

The number of people still receiving benefits under regular state programs after an initial week of aid dropped 55,000 to 3.67 million in the week ended October 1.

Economists forecast so-called continuing claims unchanged at 3.70 million.

The number of Americans on emergency unemployment benefits fell 11,412 to 3.02 million in the week ended September 24, the latest week for which data is available.

A total of 6.82 million people were claiming unemployment benefits during that period under all programs, down 39,203 from the prior week.

Pat Modell, actress and wife of Art Modell, dies (AP)

BALTIMORE ? Patricia Modell, the wife of former NFL team owner Art Modell and a longtime television actress, has died. She was 80.

Mrs. Modell was pronounced dead around 1:30 p.m. on Wednesday afternoon, the Baltimore Ravens announced after being contacted by Modell's son. She had been hospitalized for around five months.

During a 22-year acting career, Patricia Breslin Modell performed on the New York stage, in motion pictures and on television. She starred in the "People's Choice" television series with actor Jackie Cooper and played the role of Meg Baldwin in the soap opera "General Hospital." She also played Laura Brooks on the prime time soap opera "Peyton Place."

Among her many television other roles, she was a regular on "Twilight Zone," `'Alfred Hitchcock Presents," `'Perry Mason," and "Maverick."

At one point in her career, Mrs. Modell had appeared on more television shows than any other woman in U.S. history. Her record was eventually broken by one of her best friends, Lucille Ball.

She married Art Modell, former owner and president of the Cleveland Browns and Baltimore Ravens, in 1969. She retired from acting at that time and immersed herself in her family and community improvement.

In Cleveland, Mrs. Modell served on the board at Ursuline College and was active in the Make-A-Wish Foundation, the Cleveland Musical Arts Association, the Cleveland Ballet, the Playhouse Square Foundation, and the Cerebral Palsy Association. She actively supported the Cleveland Clinic Foundation, and she started and funded, along with her husband, the Hospice of the Western Reserve in Cleveland.

After Art Modell moved his football team to Baltimore in 1996, his wife served on several boards, including: House of Ruth, Gilchrist Hospice, Kennedy Krieger Institute, Baltimore Symphony Orchestra and The Walters Art Museum. In addition, the Modells contributed money to the St. Vincent's Center and the Baltimore Museum of Art.

The Modells also gave $3.5 million to the Lyric Opera House, which was recently renamed the Patricia and Arthur Modell Performing Arts Center at The Lyric.

The Modells pledged $5 million to help start a public boarding school for disadvantaged students. The SEED School, which opened in the Fall of 2008, recruits middle and high school students from around the state. The gift is believed to have been one of the largest private contributions to a single public school in Maryland.

Born in New York, Patricia Modell was the daughter of Edward and Marjorie Breslin. Her father was a Special Sessions Judge in New York City. Monsignor Patrick Breslin, for whom she was named, was Judge Breslin's eldest brother.

Mrs. Modell graduated from the Academy of Mt. St. Ursuline and the College of New Rochelle.

She is survived by her husband, two sons, John and David, and six grandchildren.

Euro zone crisis dominates G20 Paris meeting (Reuters)

PARIS (Reuters) ? The euro zone debt crisis will dominate a summit of G20 finance chiefs and central bank heads in Paris, with a downgrade of Spain's credit rating highlighting the risk of a much larger economy than Greece coming under threat.

French and German officials are trying to put flesh on the bones of a crisis resolution plan in time for a European Union summit on October 23 and parallel discussions are taking place on the need to give the International Monetary Fund more firepower.

South Africa's finance minister said the IMF and euro zone's EFSF rescue fund were ill equipped to deal with a worsening euro crisis that spreads beyond Greece.

"The resources available in the EFSF and IMF are not adequate if the contagion is going to spread any further," Pravin Gordhan said in Paris.

Fears about the damage a default by Greece -- and possibly others -- could inflict on the financial system have driven a confidence-sapping bout of market volatility since late July, with global stocks falling 17 percent from their 2011 high in May.

Underlining the challenge for European policymakers, Standard and Poor's cut Spain's long-term credit rating, citing the country's high unemployment, tightening credit and high private sector debt.

"This meeting takes place in a context where the absolute priority for the success of the G20 is to find the elements for the stability of the euro zone," a source at the French finance ministry said.

With impatience growing, finance chiefs from outside the bloc are expected to speak frankly.

"This meeting is an important staging point before (a November 3/4 G20 leaders summit in) Cannes and a valuable opportunity to put pressure on the euro zone," said a non-euro zone G20 delegate.

DIVISION

Unlike in 2009 when the G20 launched coordinated stimulus to pull the world out of crisis, the rest of the world is chafing at Europe's slow response while Washington and Beijing are sparring over the yuan currency.

A Franco-German crisis plan is likely to ask banks to accept bigger losses on their Greek debt than the 21 percent spelled out in a July plan for a second bailout of Athens, which now looks insufficient.

"It will be more, that's more or less certain," French Finance Minister Francois Baroin, who is hosting the Paris talks, said in an interview on Europe 1 radio.

It should also lay out a system for recapitalizing banks and plans to leverage the euro zone's European Financial Stability Facility to give it more punch.

Japanese Finance Minister Jun Azumi said he would share with his G20 counterparts Japan's "bitter experience" of failing to contain its 1990s banking crisis by doing too little, too late.

Whilst the EFSF has the resources to cope with bailouts for Greece, Portugal and Ireland, it would be overwhelmed by the need to rescue a bigger economy such as Italy or Spain which have come under market attack.

"We see heightened risks to Spain's growth prospects due to high unemployment, tighter financial conditions, the still high level of private sector debt, and the likely economic slowdown in Spain's main trading partners," S&P said.

The most effective method would be to turn the EFSF into a bank so it could draw on European Central Bank resources. Both Germany and the ECB are opposed to that.

The G20 may refer to the euro crisis in its communique and in closing news conferences on Saturday evening, but little else of substance is likely to be inked in with the EU summit in nine day's time the make-or-break moment.

MORE FOR IMF?

G20 sources said most BRICS economies were in favor of bolstering the IMF's capital as a crisis-fighting tool.

"We have said this before and have conveyed this again, that if emerging economies and the BRICS are called upon to contribute, we can do it via the International Monetary Fund," one of the sources said. "India is open to it, China and Brazil are also okay with the idea."

The United States insists the IMF has plentiful resources.

Another G20 source said the IMF would present a plan which had broad support to its executive board to make short-term credit lines available to fundamentally healthy countries hit by liquidity crises. It could aid euro zone countries hit by the current crisis of confidence in the bloc's sovereign debt.

The Paris meeting may give the green light to regulators for new rules on banks deemed 'too big to fail', including capital surcharges, due to be officially approved in Cannes.

Any real progress on bigger goals such as setting parameters to measure global imbalances and reining in speculative capital flows is unlikely to come before a November 3-4 summit in Cannes, where France passes the G20 baton to Mexico.

The French finance ministry source said that for Cannes, France hoped to have two or three measures agreed for countries showing imbalances: consolidation measures for those with high deficits and stimulus measures for those with surpluses.

"We are going to try to make some progress and obtain, perhaps not tomorrow or Saturday but by Cannes, a list of measures country by country," he said. "These must be measures which will have an impact on the real economy."

A separate G20 source said after preparatory talks late on Thursday that China would commit in Paris to boost its consumption through a five-year plan, via households and companies as well as infrastructure.

The G20 countries make up 85 percent of global output.

An April G20 meeting placed seven large economies under review -- the debt-burdened United States, export driven China and the economies of France, Britain, Germany, Japan and India. Officials have said privately the aim was to get Beijing to discuss the yuan, and China's cooperation is essential to the success of the process.

But the euro zone crisis has derailed French President Nicolas Sarkozy's hopes of using his G20 presidency to launch a fundamental rethink of the global financial system and its reliance on the U.S. dollar.

China and the United States sparred this week over a U.S. Senate bill to press Beijing to raise the yuan's value, and the issue is likely to create a sideshow at the G20 talks, even if the euro zone crisis pushes it off center stage.

FBI charges man in Hollywood celebrity hacking case (Reuters)

LOS ANGELES (Reuters) ? Federal officials on Wednesday arrested a Florida man and charged him with 26 counts of cyber-related crimes against Hollywood celebrities following an 11-month federal probe dubbed "Operation Hackerazzi."

Victims included actresses Scarlett Johansson, "Black Swan" star Mila Kunis and pop singer Christina Aguilera, the Federal Bureau of Investigation said.

Christopher Chaney, 35, of Jacksonville, Florida, was arrested Wednesday morning by FBI agents and accused of targeting individuals in the entertainment industry by hacking into personal e-mail accounts.

Chaney, who was arraigned in Florida on Wednesday, faces as many as 121 years in jail if convicted on all counts. Officials said the investigation remains open and others could be implicated.

U.S. Attorney Andre Birotte, Jr. told reporters that Chaney gained unauthorized access to e-mail accounts of the stars to intercept information that in some cases included "movie scripts" and "nude photos."

In September, "Iron Man 2" star Johansson joined a list of Hollywood celebrities including "High School Musical" actress Vanessa Hudgens and film star Jessica Alba, who have had private photos leaked online at the hands of hackers.

In the Johansson photos, the 26 year-old actress was shown in a towel with an exposed backside, while another showed her topless. The pictures were posted on several celebrity gossip websites before eventually being taken down.

The FBI said their investigation identified more than 50 victims, but the indictment against Chaney listed specific incidents of hacking into e-mail accounts of only 11.

Wednesday's arrest followed a scandal involving media giant News Corp after revelations earlier this year that employees of one of the company's London newspapers had hacked into the cellphones of celebrities and members of the public.

Federal officials said on Wednesday that there was no link between Chaney's arrest and the News Corp scandal.

Tidy Up Your Desktop with These Simple Folder Icons [Organization]

Tidy Up Your Desktop with These Simple Folder IconsWindows/Mac/Linux: Keeping a clean desktop can be a little difficult when it's such a convenient dumping ground for your crap. Here's a set of simple icons to prevent you from littering and, instead, keep everything nice and tidy.

I use Dropbox to keep a highly organized, synchronized home folder, which has a place called "The Dump" for dumping files. But sometimes you don't want to sync/upload absolutely everything you do and that's when files start to turn your desktop into a trash heap. To counter that problem, I created some folder icons to help me stay organized. This way there's always a folder to catch files until I can move them somewhere else or act on them. Here's how the system works:

  • Incoming Media catches all the movie and music files I've downloaded or transferred from other sources but don't intend to keep on my machine. They sit in this folder until they're watched/listened to or sorted.
  • Incoming Photos houses photos copied from an SD card before they get uploaded to Flickr. Sometimes I save the photos in Dropbox as well, but often times they need to be edited first and I'll move them to Dropbox after that's happened. This way there isn't any syncing taking place until the work has been finished.
  • Temporary Notes is where I house text files and clippings that should be deleted once they're dealt with. Despite Simplenote I still somehow manage to collect stray text files.
  • To Be Archived is probably the most important folder, as this is where files go when they need to be saved to an external drive or some other location but do not need to exist indefinitely on my computer. When I see this folder filling up, I know it's time to clear it out.

I also have a For Sale and Development folder, but those aren't as widely applicable as the others. For Sale is where I keep photos of things I'm selling on Craigslist and Development is where I keep code I'm not syncing with other machines.

You can use these icons to create a similar organizational system. If you want to add folders that are more applicable to what you do, a Photoshop template is included in the download (at the end of this post) so you can create whatever you like. Additionally, you'll get copies of the icons as a CandyBar iContainer, Mac folders, and ICO files so you can use them with pretty much anything.

If you create any new icons, please share them in the comments so everyone can use them!
